The suit is based on a privileged communication, and it will promptly be thrown out by the court." The statement continues, "To evaluate the credibility of Robert Randolph and his ridiculous lawsuit one need look no further than his own statements published on his website stating that he sustained 'permanent brain damage' and had to 'retrain' his brain." "Mr. Travolta will aggressively defend himself against this lawsuit and expects to be fully vindicated when this meritless case is dismissed." Travolta's attorney, Marty Singer, also released a statement ... saying, "This is a ridiculous lawsuit. It is based on our letter which was completely privileged under the law. We intend to sue the attorneys for malicious prosecution after the court promptly dismisses this baseless lawsuit.” 0314_divider_graphic John Travolta is being sued by an author who claims Travolta spread lies about his mental health in order to diminish his credibility ... while the author was trying to sell a book in which he claimed he personally witnessed Travolta engaged in gay sex at various bathhouses. The man behind the lawsuit is Robert Randolph -- who wrote a book entitled, "You'll Never Spa in This Town Again" ... detailing Travolta's alleged sexual exploits with other men, including Randolph. In his suit, Randolph claims ... as he was releasing his book, Travolta and his high-powered attorney Marty Singer (pictured above) unleashed a P.R. attack ... in which they falsely claimed Randolph had mental issues and spent time in a mental institution. Randolph claims the attack was concocted to persuade the public that he's an unreliable source ... and they should NOT buy his book. Randolph claims Travolta's plan worked ... and retailers were deterred from selling his book. Randolph is suing both Travolta and Singer for unspecified damages. So far, no comment from Travolta. Matt did not disclose any details regarding the nature and time frame of the abuse. Matt's lawyers said Matt did meet with investigators recently ... and was willing to testify. It's unclear why Matt was not called to the stand. The jury is now deliberating in the Jerry Sandusky case -- he's accused of sexually abusing 10 boys over a span of 15 years and faces 500 years in prison if convicted on all 48 counts. Khloe was out in New York today when we asked her about the TMZ story -- that Humphries told his ex-girlfriend that Kris Jenner directed Kim to make her infamous sex tape ... and even had Kim re-shoot it because the first take wasn't pretty enough. NBC secretly offered Meredith Vieira a big contract to replace Ann Curry on the "Today" show ... but she turned them down.

Sources connected with the network tell TMZ ... the offer was made approximately two weeks ago but Meredith wasn't interested in returning to the show she anchored for 6 years.

TMZ broke the story back in April ... Ann Curry was on her way out, partly because NBC was unhappy with her performance, partly because the ratings started to suck, and partly because Matt Lauer didn't like working with her.

As we reported, when Matt re-signed with "Today," he made it clear he wanted a new co-anchor, but NBC delayed making an immediate change because the network didn't want to make it look like a big foot on Matt's part.

From what we're hearing, Ann could be 86'd within a matter of weeks.

As for who will replace Ann, network sources say the frontrunner is Savannah Guthrie, who co-hosts the third hour of "Today."
