Stephen Baldwin had big bro Alec Baldwin's back last night ... telling TMZ that his brother is not to blame for laying that alleged smackdown on a photographer earlier this week.

The Baldwin brother (Stephen, that is) was outside Katsuya restaurant in L.A. Friday night ... where he gave us some insights into Alec's confrontation with a NY Daily News photog ... and he's adamant Alec has changed his ways.

Stephen says his brother wouldn't get violent without good reason. He adds ... if a pap instigated a "situation" ... any reaction is pure human nature.

Marcus Santos, the New York Daily News photographer who had a run-in with Alec Baldwin on Tuesday, appeared on “Good Morning America” on Thursday, and it was revealed that he spoke to detectives and prosecutors in the Manhattan District Attorney’s office for two hours.

With his attorney sitting next to him, Santos said — contrary to Baldwin’s claims — that the “30 Rock” star “threw a punch.”

The photographer said he moved back to soften the blow, which Santos claims hit him on the chin.

Santos’ lawyer said his client met with prosectors in the Manhattan D.A.’s office because “he wants justice,” and he wants “Baldwin to be held accountable,” for what they feel should be a charge of “assault.”

The Daily News staffer said he’s a “news photographer,” and doesn’t ordinarily photograph celebrities, but had been called off one assignment and asked to shoot Baldwin.

When questioned about what he would say to the actor, Santos replied, “I have nothing to say to him… I’m just feeling so embarrassed for what he did to me.”

He explained, “I like to take picture[s], my picture[s] be on the front page — not me on the front page.”

“I don’t want to be a part of the news,” added Santos.

Now you see him, now you don't -- hours after Alec Baldwin got into a violent stand-off with a New York photog, the actor hit the streets of the Big Apple ... wearing a paparazzi-proof white blanket.

As we previously reported, things got physical between Baldwin and NY Daily News photographer Marcus Santos this morning -- as Baldwin was leaving a courthouse with his fiancee Hilaria Thomas. The couple had just obtained a marriage license.

Santos has already filed a criminal assault complaint against Baldwin, but the actor insists anything he did was in self-defense. The incident is currently under investigation.

Strange, that woman in the background looks like she just saw a ghost.

Alec Baldwin insists ... he's not dumb enough to attack a photog at a courthouse for no reason ... claiming he only went after the snapper yesterday because he was provoked.

Baldwin just appeared on "CBS This Morning" ... saying NY Daily News photog Marcus Santos lunged at him as he was leaving a NYC courthouse yesterday and "almost hit me in the teeth with the lens of his camera."

Alec admits he shoved the guy back ... but says he's certain his actions were justified ... or else he wouldn't have done anything ... especially with all of the cops around.

Baldwin also says the photog has "baited me before" ... and even camped out in front of his house.

"People think I'm out there just decking photographers willy-nilly, nothing could be further from the truth."
